This legal notice (hereinafter, the “Legal Notice”) governs the use of the website https://www.ag-photonics.com/ as well as all subdomains and directories included therein (hereinafter, collectively referred to as the “Website”).

1. Identification of the Website owner

In compliance with Spanish Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, and the applicable legislation on electronic commerce that develops or complements it, we inform you that this Website is owned by AGPhotonics, S.L. (hereinafter, “AGPhotonics”), with registered office at Calle Severo Ochoa, 4, Planta 2, 29590, Málaga; Tax ID number B13745716, duly registered in the Mercantile Registry of Málaga, and whose contact email is info@ag-photonics.com.

2. User and Conditions of Use

This Website is governed by Spanish law, to which all natural or legal persons who access the Site (hereinafter, the “User”), whether national or foreign, expressly submit.

The information contained on the Website refers to the products and services offered by AGPhotonics in accordance with the regulations in force in Spain. This information is for illustrative and informational purposes only and in no way constitutes any obligation for Users.

Access to the Website by any User is free and is conditioned on the prior full, express, and unconditional acceptance of the Legal Notice and the Privacy Policy applicable at the time of access to the Website.

All users undertake to carefully read both the Legal Notice and the Privacy Policy. By using the Website or its contents or services, Users expressly accept and submit to the provisions of the Legal Notice and the Privacy Policy and declare and warrant that they will make proper use of the Website in accordance with the laws, good faith, public order, traffic customs, and this Legal Notice. 3. Intellectual and Industrial Property

All industrial and intellectual property rights over the designs, texts, images, source code, and, in general, over all the content of the Website—including, purely illustratively, photographs, logos, designs, trademarks, trade names, databases, menu structure, graphics, colors, tools, software, etc.—are protected by the applicable legislation on intellectual and industrial property and are the exclusive property of AGPhotonics, or where applicable, of third parties from whom AGPhotonics has obtained the corresponding exploitation license.

Therefore, their use, reproduction, transmission, transformation, modification, distribution, public communication, provision, extraction, reuse, exploitation, or any other use by the User is totally prohibited, except in cases where it is legally permitted or expressly authorized in writing by AGPhotonics, or as provided in these Terms of Use.

Notwithstanding the foregoing, AGPhotonics grants a non-exclusive, non-transferable, non-sublicensable license to Users to use the Website and its functionalities, content, and other available functions, subject to the rest of the Website’s Legal Notice and applicable regulations.

The User has the right only to make private and non-commercial use of the contents, texts, and images included on the Website, without profit, and must obtain express authorization from AGPhotonics and/or, where appropriate, from the corresponding rights holder to modify, reproduce, exploit, distribute, or exercise any rights belonging to its owner.

The User acknowledges and accepts that the use of the Website does not imply the transfer of any industrial or intellectual property rights from AGPhotonics to the User, nor does it constitute any authorization for the creation of derivative developments from the Website, except for the limited, non-exclusive, non-transferable, and free license granted to Users of the Website in accordance with these Terms of Use.

(e) Impersonate another User, Public Administrations, or any third parties.

(f) Reproduce, transmit, copy, distribute, make available, or otherwise publicly communicate, extract, reuse, transform, modify, or economically exploit the contents, unless authorized by the owner of the corresponding rights or as legally permitted.

(g) Collect data for advertising purposes and send advertising of any kind and communications for sale or other commercial purposes without prior request or consent.

(h) Use the Website, or any part thereof, on other private or commercial websites, as well as commercial use of the Website; or establish hyperlinks to the Website or any of its contents (except with express written authorization from AGPhotonics), refraining from making false, inaccurate, or incorrect statements about AGPhotonics, or including illicit content, contrary to morality, good customs, and public order.

(i) Any other activities contrary to the current Law, these Terms of Use, morality, good customs, or established public order, or for illegal, prohibited, or harmful purposes to the rights and interests of AGPhotonics or third parties.

Access to the Website is carried out under the sole and exclusive responsibility of the User, who will be liable in any case for damages that may be caused to third parties or AGPhotonics.

Users will be responsible for damages of any kind that AGPhotonics may suffer as a result of the User’s breach of any of the obligations established in this Legal Notice or the Privacy Policy. Likewise, the User will hold AGPhotonics harmless against any sanction, claim, or demand that may be filed by a third party, including any public bodies, against AGPhotonics, its representatives, or employees as a result of the violation of any rights of third parties or any applicable regulations by such User through the use of the Website in a manner contrary to that provided in this Legal Notice.

AGPhotonics reserves the right to block or restrict access to certain services of the Website to any User who breaches these Terms of Use, third-party rights, or applicable legislation.
